GENERAL TERMS AND CONDITIONS FOR CONCERT TICKETS

The General Terms and Conditions set out below govern the conditions for the sale of tickets by CastellHell (the "Organisation").

1. GENERAL TERMS AND CONDITIONS

These General Terms and Conditions of sale take precedence over any particular conditions that each selling entity may have, which could contradict these.

The purchase of tickets for events organised by CastellHell implies acceptance of the following conditions:

1.1. Capacity

The conditions of access and attendance at the event are subject to the regulations that, at any given time, may be applicable or adopted by the competent authorities depending on the circumstances at the time of the event, and may therefore be altered as a result of the adoption of new measures that modify the conditions in force at the time of ticket purchase.

1.2. Ticket Purchase

Once a ticket has been purchased, the amount will only be changed or refunded in the event of cancellation of the event in accordance with clause 1.3. In accordance with art. 103 of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, no changes or refunds are accepted under other circumstances.

For the correct purchase of tickets, the Organisation makes various official points of sale available to users. After selecting the chosen ticket through EVENTIX and entering the corresponding personal data, you will proceed to pay for the selected tickets. We accept credit or debit cards for payment. We inform you that the ticket sales system uses a secure server, in accordance with the Organisation's security policy.

In any case, if your purchase has been completed correctly, the Organisation will send you an email to the address provided containing your tickets. All purchases are subject to verification of the payment card and other security checks, and your transaction may be cancelled if it does not pass our verification process.

Your contract for the purchase of a ticket begins when we confirm your purchase and ends as soon as the event for which you purchased the ticket ends. This contract is governed by the provisions of these Terms and Conditions.

1.3. Cancellation, Alteration or Suspension

In the event of cancellation, the attendee may request a refund within no more than 14 days or within the legally determined period from the date of the public announcement of the cancellation, in the manner specified by the Organisation. A cancellation shall be understood as the total cancellation of the concert. Cancellation will occur due to the impossibility of attendance by the main artist contracted by the Organisation for the concert.

In the event of a refund of tickets due to cancellation, only the face value of the ticket will be refunded, including, among others, management fees. Travel, accommodation or any other expenses related to attendance at the event contracted on your own account are at your own risk, and no refund of these amounts shall be made under any circumstances.

In the event of postponement or cancellation of the event, and without prejudice to the rights recognised by these General Terms and Conditions, the Organisation may offer a compensation proposal that restores the reciprocity of interests of the contract and constitutes fair and reasonable compensation.

In the event that the suspension, modification or cancellation occurs once the event in question has begun and is due to force majeure, attendees shall not be entitled to a full or partial refund of the amount paid for the tickets.

The ticket price will not be refunded in the event of cancellation or postponement of the event due to fortuitous causes and/or force majeure, and/or any other cause beyond the Organisation's control that is recommended for reasons of safety, prudence and/or risk to third parties. Force majeure shall be understood as established by the Spanish Civil Code and the case law of Spanish courts and tribunals, and in particular, without limitation: natural catastrophes, earthquakes, floods, labour disputes, strikes, war (declared or otherwise), rebellion, shortage or unforeseeable delay in the supply of raw materials or necessary goods, fires, explosions, emergencies, accidents, or breakdown of essential machinery, equipment or tools, action or omission of public services or administration, sabotage, embargo, disturbances of any kind that seriously affect public order, epidemics or pandemics, any intervention or declaration by Public Administrations, health institutions or other bodies, both regarding the prohibition and the recommendation not to hold the event, as well as any other fact or impediment that does not allow or recommend holding the event referred to in these General Terms and Conditions, or any unforeseeable, irresistible event, independent of the Organisation's will and beyond its control, which also prevents the total or partial execution of the event and cannot be overcome by the use of average diligence.

1.4. Tickets and Resale

The Organisation does not guarantee the authenticity of the ticket if it has not been purchased at official points of sale. The Organisation assumes no responsibility in the event of loss or theft of the ticket or for failing to comply with the requirements of the corresponding ticket sales points or, where applicable, applications that, at the Organisation's discretion, are necessary for access to the event and of which attendees have been duly informed. The ticket holder or the person in whose name the ticket is personalised assumes full responsibility if their ticket is presented as a duplicate, photocopy or forgery, losing all rights granted by the ticket to access the event. Only the first ticket presented and its code validated shall be valid. Any ticket with the same code presented subsequently shall be completely invalid. Resale of the ticket is not permitted.

IMPORTANT: The code on your ticket allows access to the event only once. It is your responsibility to safeguard it and prevent it from being duplicated. Do not post your ticket on social media, do not print it at unsecured locations, and keep it out of reach of third parties or, where applicable, properly safeguard the access data that may be applicable at the Organisation's discretion for access to the event.

If you provide data for an accompanying person, you are obliged to inform them and obtain their consent to the processing of their data, which is subject to our privacy policy.

1.5. Recording and/or Reproduction of Images and/or Video

The attendee acknowledges that they may appear in images taken within the event by various means for subsequent informative dissemination and authorises such use, which will be the responsibility of each media outlet. Images may appear on the internet, so their dissemination may not be controlled.

Upon payment, your data are automatically provided to the company managing the card payment and to the bank.

Possession of the ticket does not entitle the holder or third parties to use it or its content for advertising, marketing or promotional purposes (including contests, gifts and/or draws) associated with the ticket holder or third parties. These activities will be tracked on the internet in order to establish the relevant liability.

All image rights and intellectual property rights are reserved. Any filming, recording or reproduction inside the event is prohibited without the express authorisation of the Organisation.

1.6. Queries and/or Questions

In case of doubt or query, information is available on the CastellHell website. Interested parties will find complaint forms available at the concert or event venue and at our registered address. You can obtain information on consumer services at http://consum.gencat.cat/es/inici/index.html

1.7. Language and Download of these General Terms and Conditions

The language of the contract is according to the language chosen.

This document in which you accept the conditions is archived in our computer system. You have access to our data for one month and can print it and save it in your system.

2. ACCESS TO THE EVENT

To access and enter the event you must show your ticket via the means indicated by the Organisation, which will be scanned for verification.

Tickets purchased through the Bono Cultural Joven are non-transferable, so holders must duly prove their identity in order to access the event. If the identity of the ticket holder does not match the Bono Cultural Joven beneficiary, the attendee will not be allowed access to the event.

The Organisation will deny access to the event if any of the following circumstances apply:

i. The ticket is incomplete, amended, torn or shows signs of forgery.

ii. The attendee displays a violent attitude or publicly incites hatred, violence, or discrimination on the grounds of birth, race, sex, religion, opinion, disability, sexual orientation, gender identity or any other personal or social condition or circumstance, and in particular an attendee who behaves aggressively or causes disturbances inside or outside the entrance, who carries weapons or objects that could be used as such, or any other object prohibited by the Organisation, or who wears clothes, objects or symbols that incite violence or constitute apologia for activities contrary to the fundamental rights recognised in the Law and in the Spanish Constitution.

iii. The attendee shows signs of intoxication or of consuming or having consumed drugs or narcotic substances.

The exercise of the right of admission shall not, under any circumstances, result in the denial of access to the holder on grounds of birth, race, sex, religion, opinion, disability, sexual orientation, gender identity or any other personal or social circumstance or condition.

Upon entry to the event, the attendee may be subject to a search under the Law. Objects that may be considered dangerous by the Organisation or are prohibited under current regulations are not permitted.

The Organisation may deny access or expel from the event any attendee who fails to comply with the instructions of the Organisation's staff, as well as in cases where it can reasonably be presumed that a situation of risk or danger will be created for themselves or other attendees, or due to apparent or potential states of intoxication, with the attendee being personally responsible in all cases for their own actions and omissions that cause injury to third parties or damage to property.

4. MINORS

General regulation in Barcelona and Madrid: Minors between 16 and 18 years of age may attend alone. Minors under 16 years of age may only attend accompanied by a parent or legal guardian.

IMPORTANT: Check the specific minor conditions for each concert at the corresponding point of sale.

5. DATA PROTECTION

You can find information about the processing of your personal data in the Organisation's privacy policy on the CastellHell website at www.castellhell.party.

6. ALTERNATIVE DISPUTE RESOLUTION

The Organisation has an active dispute resolution policy. We inform you that, pursuant to Art. 40 of Law 7/2017, access is provided to the online dispute resolution platform available at the following link: https://ec.europa.eu/consumers. Notwithstanding this, we will decide on a case-by-case basis whether or not to adhere to this system, as we believe that disputes can and should be resolved outside these frameworks. We therefore advise that, prior to any complaint, you use our customer service system at info (at) castellhell.party. Thank you for your understanding.

7. INTERPRETATION, APPLICABLE LAW AND COMPETENT COURTS

These General Terms and Conditions shall be governed by the applicable Spanish legislation.

Where applicable law allows the parties to choose jurisdiction, the parties, expressly waiving any other jurisdiction that may correspond to them, agree to submit any disputes arising from the interpretation or application of these General Terms and Conditions to the courts and tribunals of the city of Barcelona, without prejudice to the rights of any attendee who is a consumer, who may bring a claim before the courts of their place of domicile.

In case of doubt as to interpretation, the Spanish version of these conditions shall prevail over any version in another language.

8. RESERVATION

The Organisation may cancel or modify any of the above conditions or inform of incidents, in which case it may make this known to the attending public through the channels it deems appropriate.
